St. CLOUD – A man has been sentenced at a Sauk Center for serving liquor to a 13-year-old girl and then sexually assaulting her.
A Stearns County judge has sentenced a 20-year-old Jose Bricino Hernandez To stop imposing and seven years of probation. He must also register as a predatory offender, cannot use any mood-altering chemicals, and be subject to any chemical or psychological treatment plans as specified.
Briceno Hernandez pleaded guilty in September to third-degree criminal sexual conduct with a victim between the ages of 13 and 15 while he was two years older than her.
Briceno Hernandez and the girl were in the same house one day in August when the two started drinking whiskey. The girl told the authorities that she had become very drunk.
Court records show that Briceno Hernandez then brought the victim into a bedroom and forced the girl to perform a sexual act. The girl said that after that he forced her to have intercourse.
Briceno Hernandez told police he knew the girl was 13 and had confessed to drinking alcohol and having sex with her.
He got credit for spending 33 days in prison.
